Open Justice and Confidentiality in the Tribunal
From 1 January 2009 amendments to the Guardianship and Administration Act 2000 take effect to enhance the focus on open justice and procedural fairness for active parties in the Tribunal and at the same time continue to provide protection for the privacy of adults with impaired decision-making capacity.
The amendments require that serious harm or injustice be demonstrated before the Tribunal can make a limitation order that restricts access to a relevant document or information, prevents publication of proceedings or limits who may attend a hearing.
For further information refer to Fact Sheet 9.
A new Presidential Direction, 1 of 2009 (to take effect from 1 January 2009) has been issued in relation to the Arrangements for File Inspection.
